OPERATING ENTITY: KNOWDYN LTD (Company Registered in England and Wales)

SERVICE NAME: Scientomics

PLATFORM: scientomics.com

JURISDICTION: United Kingdom / International

REGULATORY SCOPE

This Compliance and Operational Policy (“The Policy”) establishes the statutory and operational frameworks governing all commercial, investigative, and technological activities executed by KNOWDYN LTD operating as Scientomics (“The Firm”).

This framework is structurally designed to ensure strict compliance with the laws of England and Wales, alongside relevant international legal standards, concerning the specific Standard Industrial Classification (SIC) codes under which the Firm operates:

  • SIC 62012: Business and domestic software development (Governing the Scientomics algorithmic infrastructure and Secure Intake Portals).
  • SIC 70229: Management consultancy activities other than financial management (Governing the provision of forensic metascience intelligence and advisory mandates).
  • SIC 77400: Leasing of intellectual property and similar products, except copyright works (Governing the licensing, dissemination, and authorized utilization of Scientomics’ proprietary methodologies and data archives).

PART I: TECHNOLOGICAL INFRASTRUCTURE & SOFTWARE GOVERNANCE

This section governs the deployment, utilization, and security of the Scientomics digital infrastructure, including its proprietary data-scraping software, anomaly-detection algorithms, and encrypted transmission gateways.

1.1. Provision of Software as a Service (SaaS)

The Scientomics platform and its associated cryptographic intake gateways are provided on an “as is” and “as available” basis. The Firm develops and maintains its proprietary infrastructure to facilitate the secure transmission and forensic analysis of scientific datasets. The Firm warrants that its software architecture is designed in alignment with industry-standard cyber resilience protocols (e.g., ISO/IEC 27001 frameworks for Information Security Management).

1.2. Acceptable Use and System Integrity

Clients and Disclosers interacting with the Scientomics infrastructure are strictly prohibited from:

  • Reverse-engineering, decompiling, or attempting to extract the source code of the Firm’s algorithmic anomaly detection tools.
  • Deploying automated penetration testing, DDoS operations, or unauthorized vulnerability scraping against the scientomics.com domain without express, prior written authorization from KNOWDYN LTD.
  • Utilizing the secure intake software to transmit classified state secrets, illicit materials, or malware payloads.

1.3. Service Level and Liability Limitations

As a provider of highly specialized business software, the Firm accepts no liability for system downtime, data transmission interruptions, or cryptographic failures resulting from zero-day vulnerabilities, sovereign state interference, or force majeure events.

PART II: FORENSIC ADVISORY & MANAGEMENT CONSULTANCY

This section regulates the Firm’s engagement as an independent intelligence advisory and management consultancy. Scientomics provides objective, data-driven intelligence to academic institutions, publishers, and oversight bodies to mitigate the operational and reputational risks associated with compromised research.

2.1. Nature of the Advisory Relationship

Scientomics operates exclusively as a forensic intelligence and strategic advisory consultancy. The Firm does not provide legal representation, financial auditing, or regulatory adjudication. All statistical proofs, linguistic analyses, and forensic reports generated by the Firm constitute strategic intelligence designed to inform the Client’s internal management decisions.

2.2. Client Due Diligence (CDD) and Anti-Money Laundering (AML)

In compliance with the UK Money Laundering, Terrorist Financing and Transfer of Funds Regulations 2017, the Firm executes strict Know Your Customer (KYC) and CDD protocols for all commercial Bespoke Mandates. The Firm reserves the right to decline or terminate engagements with entities subject to international sanctions, or those failing to provide verifiable institutional credentials.

2.3. Anti-Bribery and Corruption (ABC) Compliance

Pursuant to the UK Bribery Act 2010, KNOWDYN LTD strictly prohibits all forms of bribery, facilitation payments, and corrupt practices. The Firm conducts its forensic investigations with absolute clinical objectivity. Commercial compensation (Service Quotations) covers the allocation of forensic resources and software utilization; it does not guarantee a predetermined investigative outcome or the confirmation of a Client’s preferred hypothesis.

2.4. Conflict of Interest Mitigation

Prior to the execution of any Bespoke Mandate, the Firm conducts a rigorous conflict of interest audit. Scientomics will not accept a commercial mandate to investigate an entity with which the Firm or its directors hold concurrent financial or strategic entanglements.

PART III: INTELLECTUAL PROPERTY LEASING & ARCHIVAL ACCESS

Because Scientomics deals in the extraction and algorithmic modeling of data, the resultant intelligence is classified as proprietary intellectual property. This section governs the leasing, licensing, and transfer of these assets.

3.1. Work-Made-For-Hire Asset Transfer (Bespoke Mandates)

For commercially funded investigations, KNOWDYN LTD leases and subsequently transfers the intellectual property of the final forensic report to the Client.

  • Upon receipt of full financial settlement, the Client is granted an exclusive, perpetual, and global license to utilize the specific data analysis generated.
  • The Firm retains absolute ownership over the underlying methodologies, software algorithms, and proprietary statistical models utilized to generate the report. The Client is leasing the output, not the operational mechanics of the Firm.

3.2. Licensing of Public Interest Intelligence (Anonymous Disclosures)

Forensic reports generated at the Firm’s expense via the Whistleblower Gateway remain the exclusive intellectual property of KNOWDYN LTD.

  • When disseminating these reports to designated beneficiaries (e.g., academic boards or funding bodies), the Firm grants a strictly non-exclusive, non-transferable, and revocable license for internal review and oversight purposes.
  • Beneficiaries are prohibited from commercializing, syndicating, or redistributing the Firm’s proprietary data structures without explicit licensing agreements.

3.3. Defamation and Libel Shield (Defamation Act 2013)

To protect the Firm’s leased intellectual property, all Scientomics reports are issued under the legal defenses of Truth, Honest Opinion, and Publication on a Matter of Public Interest pursuant to the UK Defamation Act 2013. Clients leasing the Firm’s IP assume full legal liability for any subsequent public dissemination of the intelligence that violates the parameters of the Firm’s operational definitions.

PART IV: DATA PROTECTION & STATUTORY PRIVACY (UK GDPR)

This section codifies the Firm’s compliance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018 (DPA 2018).

4.1. Lawful Basis for Processing

The Firm processes administrative personal data for commercial clients under the lawful basis of Contractual Necessity and Legal Obligation. The processing of publicly available researcher metadata (e.g., ORCID, ROR ID) for investigative purposes is executed under the lawful basis of Legitimate Interests (the detection and prevention of academic fraud).

4.2. The Investigative Exemption

Under Schedule 2 of the DPA 2018, certain provisions of the UK GDPR (including the right to be informed and subject access rights) may be restricted if their application would prejudice the prevention or detection of fraud, or severely undermine the Firm’s journalistic/investigative mandate to protect the integrity of the scientific record.

4.3. Whistleblower Architecture and Zero-Retention Protocol

While the Firm supports the principles of the Public Interest Disclosure Act 1998 (PIDA), it operates independently of internal institutional HR frameworks. To ensure the safety of external whistleblowers, the Scientomics Secure Gateway operates on a zero-knowledge, encrypted basis. The Firm technically cannot comply with Subject Access Requests (DSARs) or Deletion Requests regarding Anonymous Disclosures because no personally identifiable routing data or IP metadata is collected or retained by the server.

PART V: JURISDICTION AND DISPUTE RESOLUTION

5.1. Governing Law

This Master Compliance and Operational Policy, and all ensuing commercial or operational relationships with KNOWDYN LTD, shall be governed by and construed strictly in accordance with the laws of England and Wales.

5.2. Exclusive Jurisdiction

Any dispute, controversy, or claim arising out of or relating to this Policy, the use of the Scientomics platform, or the deployment of the Firm’s software and advisory services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

5.3. Severability

If any provision of this Policy is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to render it enforceable while preserving the Firm’s original operational intent.
